What is an Undisclosed Dual Agent?

Undisclosed Dual Agency occurs when a broker attempts to work for both the buyer and the seller on the same property without having obtained the informed consent of both parties.  In this case, the broker tells both the buyer and the seller that they represent their interest exclusively. This is misrepresentation and is illegal.
