Mandatory Agency Disclosure
If there is one thing that too few people do, it is learning the documents BEFORE they sign them. This was, in part, due to the fact that people had no access to them before they were already being presented to be signed. When I work with you I have blank copies of all of the forms and documents that you will need available for your perusal at any time. Whether they be contracts, offers, or addenda. You can ask me anything about any of them before you sign anything. This is the way this business should be run.
The Law
According to Massachusetts Law, upon your first meeting with a real estate agent to discuss a specific property, you must be presented with the following document. This “Agency Disclosure” form was designed to protect the consumer by making sure you are aware, before you develop a relationship with any agent, whom that agent actually represents.
Although this disclosure has been mandatory for over 15 years now, many agents still don't present it upon meeting with buyers for the first time. This is illegal. You have the right to know up front what the agent's role is in the transaction - whether they are representing you, the buyer, both, or neither.
